Did you know that in Vail you can hit a cyclist with your vehicle, flee the scene, fail to report that you hit anyone, and get away nearly scot-free?
That's the way it's working out for Martin Erzinger, a Denver-Area wealth manager, who was sentenced to a year’s probation and a suspended jail term on Thursday.
Erzinger said he fell asleep while driving on U.S. Highway 6 near Avon on July 3, striking cyclist Steven Milo, a 34-year-old anesthesiologist from New York.
How did this happen? Here is a clue. Eagle County District Attorney Mark Hurlbert apparently doesn't think the law should extend to a person of Erzinger's social status. Said Hurlbert: “felony convictions have some pretty serious job implications for someone in Mr. Erzinger’s profession.”
Erzinger said he'd fallen fell asleep when the 2010 Mercedes sedan he was driving drifted to the side of the road on U.S. Highway 6 near Avon on July 3.
The decision - handed down on Thursday - has outraged cyclists across the U.S. Some are calling for a boycott of Vail. Others are asking the Quiznos Pro Challenge to relocate its Aug. 25 Vail time-trial stage and stage start in Avon on Aug. 26.
